Terms of Service
The rules and conditions governing use of Best Cabo Payments.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Operator") and Lucrative Merchants LLC, operating as Best Cabo Payments ("Company," "we," "us," or "our"). By accessing or using the Best Cabo Payments platform, you agree to these Terms in full.
2. Description of Service
Best Cabo Payments is a software platform that enables yacht charter and tour operators to:
- Accept credit and debit card payments from customers
- Manage bookings, availability, and customer records
- Receive payouts to a connected bank account via Stripe
- Access reporting and analytics for their business
Payment processing is provided by Stripe, Inc. and is subject to Stripe's Terms of Service. By using Best Cabo Payments, you also agree to Stripe's Connected Account Agreement.
3. Operator Eligibility
To use Best Cabo Payments, you must:
- Operate a legitimate charter, tour, or hospitality business
- Be authorized to enter into legally binding contracts
- Complete Stripe's identity and business verification process
- Maintain a valid bank account for receiving payouts
- Comply with all applicable laws in your jurisdiction
4. Platform Fees
Use of Best Cabo Payments is subject to the following fees:
- Monthly subscription: As listed on our pricing page, billed monthly in advance.
- Platform fee: 0.75% of each payment transaction processed through the platform, automatically deducted by Stripe before payout.
- Stripe processing fee: Standard Stripe rates (approximately 2.9% + $0.30 per transaction) apply in addition to our platform fee.
We reserve the right to modify fees with 30 days written notice to registered operators.
5. Prohibited Uses
You may not use Best Cabo Payments to:
- Process payments for illegal goods or services
- Engage in fraudulent transactions or misrepresent your business
- Violate any applicable laws or regulations
- Circumvent Stripe's prohibited businesses policy
- Resell or sublicense access to the platform without authorization
6. Customer Data
Customer records created through your account belong to you. You are responsible for obtaining appropriate consent from your customers to collect and store their personal information in accordance with applicable privacy laws including GDPR and CCPA where applicable.
7. Payouts and Holds
Payouts are processed by Stripe on a standard rolling schedule (typically 2 business days). We reserve the right to hold funds or suspend payouts if we detect suspicious activity, chargebacks, or violations of these Terms. We are not liable for delays caused by Stripe's payout processes.
8. Chargebacks and Disputes
You are responsible for all chargebacks and payment disputes related to your bookings. We may deduct chargeback amounts and associated fees from your account balance. You agree to cooperate fully in providing evidence to dispute fraudulent chargebacks.
9. Termination
Either party may terminate this agreement at any time. Upon termination, you retain access to your customer and booking data for 30 days, after which it may be deleted. Monthly subscription fees are non-refundable upon cancellation.
10. Limitation of Liability
To the maximum extent permitted by law, Best Cabo Payments and Lucrative Merchants LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost revenue, lost bookings, or data loss.
11. Governing Law
These Terms are governed by the laws of the State of Washington, United States. Any disputes shall be resolved in the courts of King County, Washington.
